What does R eal E state O wned Properties really mean today?

 

 

Lake and Town Realty Agents recently had many phone calls within the last couple weeks in asking what are REO's are all about? What REO properties are For Sale in Huntersville, NC.  

When a property is sold through a foreclosure auction, its owner usually owes more to the lender than the market value of the property itself. This is often a barrier to selling the property, and sometimes such foreclosure auctions do not draw any bidders. As a result, not many foreclosure auctions end with the sale of the property, rather the title reverts back to the financial institution holding the lien. Properties in this category are referred to as REO (Real Estate Owned) properties.

After the bank takes possession of the property, the mortgage loan disappears and the financial institution deals with any items owed by the prior borrower, such as homeowner association fees. The financial institution also tries to get the IRS to remove any tax liens against the property. The current owners are usually evicted and often repairs are made to damage on the property in order to make it more attractive to potential buyers.

The best parts of buying a REO property are that buyers have significant leverage and may be able to turn the property around quickly, making money by speculating on above average returns. Banks are trying to get the maximum return when they sell an REO property directly. They want to sell them quickly for two main reasons: first, they don't want to tie up their money in capital reserves they are required to set aside for a foreclosed property, and second, the management of such properties is a headache they would rather not have.

However, banks are very sophisticated when it comes to managing REOs and foreclosures, often having a department dedicated to them. The selling process starts when a potential buyer makes an offer to the financial institution, which is gone over by its management. Often, the institution will make a counteroffer, and the buyer may respond with another offer. After they have agreed on the price, terms, and conditions, a contract for the sale can be made.

When preparing to make an offer, a potential buyer needs to look at what comparable properties in the area are worth, along with the cost of any needed repairs. Financial institutions usually sell such properties as-is, which makes the buyer's inspection even more important. If they discover damage that they did not anticipate, which the institution will not repair, they can then cancel the transaction.

Investors dedicate much to buying REO properties in terms of funds (often cash), work, time, and effort, thus the price needs to be far enough below market value to justify the risk. Foreclosures are properties that already have had problems that often include tax issues, a lack of maintenance, substantial repairs, and often needed improvements that cost a significant amount of money, and any investor looking to buy such a property needs to keep this in mind at all times.

Does an owner have to accept pets?

No.
Our Property Investment Manager can give you more complete information about what competing properties may or may not allow as well as special terms that we may wish to add to any lease where a pet is involved.

Collection Procedures:

All rents are due on the 1st of the month and late on the 6th.
First notices are mailed on the 6th of each month.
Second notices are mailed on the 10th of each month.
Court cases are initiated against all delinquent residents on the 21st of each month.
There are no additional fees to an owner for any delinquency or magistrate court costs although the resident will incur additional costs.

How is maintenance handled?

All Agents and Owners have access to phone, text, or email live 24 hours a day for all emergency situations.
Non emergencies are handled by Maintenance Facilitators or Agents plus a long list of in-house and sub-contractor technicians.

Who holds the Security Deposit(s)?

N.C. General Statutes require that security deposits be segregated from other funds and held in a separate escrow account in a bank or savings & loan.
Lake and Town Realty maintains all security deposits in a separate escrow account and is the fiduciary under N.C. General Statutes.
The security deposit can not be disbursed to anyone until a resident vacates and then it can only be disbursed to either the owner or the previous resident.

Is everyone insured/bonded who handles the money?

Yes.
Our 3-D Fidelity Bond covers everyone who handles money.
We are active members of and support the Code of Ethics of the National Association of Realtors and the Institute of Real Estate Management.
We only use IREM-certified, double-entry accounting software with detailed audit trails for every account, receipt and disbursement.

When does an owner get his/her check?

We disburse all funds every 30 days.
Owners are mailed checks for the net proceeds of their investments on the 10th business day of each month.
In addition, we include an itemized accounting statement, information about each resident and original copies of every invoice we paid that month (if any).

How much rent can I get for my house/condo/duplex/apartment?

Yes, we are a full service real estate agency in business since 2004 and have closed over $20 million in sales from new construction waterfront to starter homes, have a full-time sales department and a working relationship with many Realtors in the local market. What are Lake and Town Realty's normal management fees?

All of our fees are negotiable.
Generally, we earn approximately 40% of the first month's rent for each new resident and approximately 9% of the gross collections in all other months, for properties in Mecklenburg County.
For non-Mecklenburg properties, we normally earn 50% of the first month's rent and 8-10% of the gross collections in all other months.
Our fees to manage Home Owner Associations vary depending on the specifications & needs of the association.

What is Errors & Omissions insurance and do I need it?

Errors & Omissions insurance is important business protection for claims resulting from an act or omission in the performance of real estate services by the owner or his agent(s).
Acts that are customarily covered include physical injury, pain or disease related to such claims as false arrest, wrongful eviction, pollutants, libel or slander and fair housing, to name a few.
In most cases, acts covered by E&O policies are not insured under traditional general liability policies.
Every owner needs E&O insurance protection.
Lake and Town Realty provides E&O protection to every client at a very substantial savings. Owners currently pay less than $5 per unit per year for this protection.
